1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of Flashlight: Strobe Light ("the App"), provided by EEB Consultancy LLC ("we", "us", or "our").
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.
2. The App
Flashlight: Strobe Light provides lighting and signaling features using supported capabilities of your device. Depending on your device and the features you choose, the App may provide flashlight, strobe, screen-light, cycling, walking, running, emergency, sound-reactive, motion-reactive, and custom lighting functions.
Some features may require access to supported device hardware or permissions, including the microphone or motion sensors. Feature availability may vary depending on the device, iOS version, permissions, hardware limitations, and environmental conditions.
3. Current Availability and Pricing
The current version of the App is provided without a required paid subscription or in-app purchase to access its available features.
We may introduce optional paid features, subscriptions, or other purchase options in a future version of the App.
If paid products are introduced in the future, applicable prices, billing periods, renewal terms, and other purchase information will be presented to you before you choose to purchase them and will be subject to applicable App Store terms and policies.
4. Safety and Responsible Use
You are responsible for using the App safely and appropriately for your circumstances.
Do not operate or interact with the App in a way that distracts you while driving, cycling, running, walking in traffic, or performing any activity that requires your full attention.
When using the App while cycling or participating in another moving activity, configure the App before beginning and keep your attention on your surroundings.
Flashlight: Strobe Light is a supplemental visibility and signaling tool. It is not a substitute for legally required, certified, or dedicated safety equipment such as bicycle lights, reflectors, vehicle lights, emergency equipment, or other safety devices.
5. Flashing Light and Photosensitivity Warning
The App can produce flashing, pulsing, strobing, rapidly changing, or high-intensity light patterns.
Flashing lights may cause discomfort, dizziness, disorientation, migraines, seizures, or other adverse reactions in people who are sensitive to flashing or rapidly changing light, including people with photosensitive epilepsy.
Do not use strobe or rapidly flashing features if you know or suspect that you or someone nearby may be sensitive to flashing lights. Stop using the feature immediately if you or another person experiences discomfort or an adverse reaction.
Use flashing-light features responsibly around other people and avoid directing intense or flashing light into anyone's eyes.
6. Cycling, Walking and Running Features
Cycling, walking, and running features are intended to provide supplemental visibility or lighting effects. Their performance may depend on device position, movement, sensor availability, environmental conditions, and other factors.
Motion-reactive or braking-related behavior is not guaranteed to detect every movement, slowdown, stop, or braking event and may occasionally react when no such event occurred.
Do not rely on the App as your sole method of visibility, signaling, navigation, collision avoidance, or personal safety.
7. Emergency and SOS Features
Emergency, SOS, beacon, and signaling features are provided as supplemental visual tools only.
The App does not contact emergency services, law enforcement, medical providers, rescue services, or other third parties on your behalf.
The App is not emergency-response equipment and must not be relied upon as your only means of requesting assistance or communicating during an emergency.
In an emergency, contact the appropriate local emergency services using an available and reliable method.
8. Sound-Reactive Features
Sound-reactive features may analyze nearby audio through the device microphone to create lighting effects based on detected sound characteristics.
Beat or sound detection may vary depending on music, volume, background noise, microphone placement, device hardware, and environmental conditions. We do not guarantee that lighting effects will match every beat or sound event.
9. Device Heat, Battery and Hardware
Continuous use of the device torch, high screen brightness, rapid flashing, microphone processing, motion sensors, or other device capabilities may increase battery consumption and may cause your device to become warm.
Extended or intensive use may cause iOS or the device hardware to reduce performance, dim the display, limit the torch, or otherwise manage device temperature.
Stop using the App if your device becomes unusually hot or if the operating system displays a temperature warning.
10. License to Use the App
Subject to these Terms and Apple's applicable App Store terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the App for lawful personal purposes.
You may not copy, redistribute, sell, rent, sublicense, reverse engineer, modify, or exploit the App except where such restriction is prohibited by applicable law.
11. Acceptable Use
You agree not to use the App:
- for unlawful purposes;
- to intentionally distract, harass, threaten, or endanger others;
- to deliberately direct intense or flashing light at people in an unsafe manner;
- in violation of applicable traffic, safety, or other laws;
- in a way that interferes with the normal operation of the App or your device.
12. Intellectual Property
The App, including its software, design, branding, graphics, interfaces, and other original content, is owned by or licensed to EEB Consultancy LLC and is protected by applicable intellectual property laws.
These Terms do not transfer ownership of the App or any associated intellectual property to you.
13. Apple and Third-Party Services
The App operates on Apple's iOS platform and may rely on services, frameworks, hardware capabilities, or system features provided by Apple.
The App may also provide links to external pages, including its Privacy Policy and these Terms of Use.
Your use of Apple services or external websites is subject to the applicable provider's terms, conditions, and privacy policies.
14. Availability and Changes
We may update, modify, add, remove, suspend, or discontinue features of the App where reasonably necessary, subject to applicable law.
We do not guarantee that every feature will be available on every device or iOS version.
Future versions of the App may differ from the features, functionality, or availability described in these Terms.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
We do not guarantee uninterrupted or error-free operation, perfect sensor detection, exact beat synchronization, reliable detection of braking or movement, or suitability of the App for any particular safety-critical purpose.
16. Limitation of Liability
To the maximum extent permitted by applicable law, EEB Consultancy LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the App.
This includes, without limitation and to the extent permitted by law, losses or damages arising from reliance on lighting, signaling, motion detection, braking detection, sound-reactive, SOS, or other App features.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
17. Termination
You may stop using the App at any time by deleting it from your device.
We may restrict access to the App where permitted by law if these Terms are materially violated or if necessary to protect the App, users, or our legal rights.
18. Changes to These Terms
We may update these Terms when the App, applicable laws, or our practices change.
When these Terms are updated, the "Last updated" date at the top of this page will be revised.
19. Governing Terms
These Terms are intended to operate together with any mandatory rights you have under applicable law and with the terms that apply to your use of Apple's App Store.
If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
